Terms of Use

1. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Aura on any iOS device you own or control, solely for your personal, non-commercial use.

2. Acceptable use

You agree NOT to:

• Use Aura for any unlawful purpose or in violation of any applicable law.
• Submit prompts in the Create feature intended to generate content that is sexually explicit, violent, hateful, harassing, defamatory, infringing of intellectual property, depicting real identifiable individuals without consent, or depicting minors in any sexual or suggestive context.
• Reverse engineer, decompile, or attempt to extract the source code of Aura, except to the extent expressly permitted by applicable law.
• Use automated means (bots, scrapers) to interact with Aura's backend.
• Resell, sublicense, or otherwise commercially exploit AI-generated outputs in a manner inconsistent with the AI provider's own terms.

We reserve the right to block requests, suspend access, or terminate use for violations.

3. AI-generated content

Aura generates wallpapers using third-party AI image generation services. By design:

• Outputs are produced algorithmically; we make no guarantee of accuracy, originality, or uniqueness.
• Outputs may occasionally include unintended artifacts, anatomical errors, or content that does not match your prompt.
• You are responsible for reviewing outputs before saving, sharing, or otherwise using them.
• We apply content-safety filters provided by the upstream AI service, but cannot guarantee they catch every edge case. Report problematic outputs to info@penfai.com.

Ownership of AI outputs: To the extent permitted by law, you may use the wallpapers Aura generates for your personal use on your own devices. Aura does not claim copyright on AI-generated outputs. The legal status of AI-generated images is evolving and varies by jurisdiction; consult a lawyer before commercial use.

4. Aura Plus subscription

Aura offers an optional auto-renewable subscription called Aura Plus that unlocks unlimited Create generations, removes ads, and provides early access to new art styles.

4.1 Subscription pricing and terms

• Aura Plus Weekly — $4.99 USD per week (no free trial)
• Aura Plus Yearly — $39.99 USD per year, with a 7-day free trial for new subscribers
• Prices in other currencies will match Apple's regional price-tier mapping.

4.2 Auto-renewal (Apple-required disclosure)

Payment will be charged to your Apple Account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account will be charged for renewal within 24 hours prior to the end of the current period at the price of the selected subscription. You can manage and cancel subscriptions by going to your Apple Account Settings after purchase.

4.3 Free trial conversion

If you start a free trial, you will be charged the subscription price at the end of the trial period unless you cancel at least 24 hours before the trial ends. No partial refunds are issued for the unused portion of a subscription period.

4.4 Refunds

All purchases are processed by Apple. Refund requests are handled by Apple under Apple's refund policy. Visit support.apple.com/en-us/HT204084 to request a refund.

4.5 Cancellation

To cancel: iOS Settings → [your Apple ID] → Subscriptions → Aura Plus → Cancel. Cancellation takes effect at the end of the current billing period.

5. Free tier

The free tier of Aura provides one daily AI-generated wallpaper, access to the saved gallery, and Create functionality limited by daily quota and supported by advertising. Free-tier features may change. The daily wallpaper drop is provided on a best-effort basis; we do not guarantee uninterrupted availability.

6. Intellectual property

Aura, including its name, logo, design, screens, and code, is owned by Penfai LLC and protected by intellectual property laws. AI-generated outputs are governed by Section 3.

7. Third-party services

Aura integrates with third-party services (Apple App Store, Adapty, Google AdMob, AI image generation providers, Sentry, Apple Push Notification Service). Your use of those features is also governed by the third parties' terms and policies. We are not responsible for third-party services.

8. Disclaimers

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT AI-GENERATED OUTPUTS WILL MEET YOUR EXPECTATIONS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PENFAI LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR AURA PLUS IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

10. Indemnification

You agree to indemnify and hold harmless Penfai LLC from any claim arising from your violation of these Terms, your misuse of the App (including but not limited to submitting prohibited prompts in the Create feature), or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the App at any time for any reason, including violation of these Terms. Subscription-related sections survive termination.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, except where local consumer-protection laws require otherwise.

13. Apple Standard EULA

As required by Apple, the following provisions also apply to your use of Aura:

• These Terms are concluded between you and Penfai LLC, not with Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
• Penfai LLC (not Apple) is responsible for any product liability, legal compliance, and claims that the App or your possession and use of it infringes third-party intellectual property rights.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Changes

We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date and, where appropriate, surfaced in-App.
